Here we go again. I am a Court watcher. I have palpitations thinking about this next fight for the vacancy on the Court. I hope that President Obama does not take the wimpy, low road with his next selection. I want a Liberal (with a capital ‘L’) on that Court to battle the heavy-weighted Conservative side of the Court. We are already living with the consequences of what this Conservative Court is doing (and I am not speaking of Bush V Gore, which still makes my head explode). The conservative Court is siding with big business and corporations against the little guy. If another seat is taken by a Supreme who does not empathize with ‘we’ the people, we are surely doomed. The Supreme Court has a website and there is a blog (not surprising, of course dedicated to the Supreme Court. There is even a Supreme Court Historical Society.
A President’s Supreme Court choice changes the course of the country and its future. It should not be taken lightly or easily. The Repugnants are already threatening to filibuster, delay, stall and otherwise deny the President his choice (even before he has selected someone). The Repugnants have to choose their battles before the midterm elections. Do they really want to send the summer doing battle over a nominee to the Court? Will the Tea Party care? Are placards already being printed up? What idiocy will Michelle Bachman and Sarah Palin dream up to spew venom over Obama’s choice. Whatever it is – it will surely fit on a bumper sticker.
– Justice John Paul Stevens was a selection by Republican President Gerald R. Ford. By the way, Justice Stevens is the only Protestant left on the Court. I hope Obama does not think he has to fill his seat with another Protestant. Religion should not be a litmus test. Although, if he does pick a Catholic, that would make six Catholics on the Court. Oy! During Gerald Ford’s era Republicans were mostly moderate (except for the flamers). Over the years Justice Stevens seemed to turn into a Liberal but he insists that the rest of the Court became more Conservative and he never changed. Jonathan Turley writes about Justice Stevens.

– From yesterday’s New York Times is an article called An Honor Justice Stevens Might Rather Forget. “In 1998, the court was asked to review the constitutionality of the drive to crack down on adult clubs and shops by the administration of the mayor at the time, Rudolph W. Giuliani. The industry’s lawyers asked the court to delay the enforcement efforts while the justices considered the case. Justice Stevens granted a legal stay.
The strip club Scores was so grateful that it renamed its Champagne Room the John Paul Stevens Room“.

It’s not the end of the world it just feels that way. The embarrassing, very sad loss of Ted Kennedy’s Senate seat yesterday by the uber-incompetent Martha Coakley to Scott Brown is crushing. The Dunderdrats have done it again. They have run a disastrous campaign, read the populace totally wrong and managed to upset the entire deck of cards in the process. The saying ‘turning over in one’s grave’ is not even close to what must be happening to Ted Kennedy, et all. By the way – Happy Anniversary, Mr President.
Last week when two of my Massachusetts pals spent some time at Casa Lobo I told them of my fears about the election. One, a long time MA resident, could not believe it was going to happen and was sure the Dems would come to the aid of the party. A newer state resident thought perhaps it was all media hoopla. But, Lobo saw something else. I saw a detached candidate, a frenzied populace and an upset in the making.
Is this the sort of thing that could happen in the state of New York in the very messy Kirsten Gillibrand situation? Me thinks, it can. Stay tuned.
So what’s a party to do? We still have a 18 seat majority. This is HUGE (or YOOGE as they say in my hometown of Brooklyn). Hunker down – get this reform-lite health care bill passed and move on the the biggest issue that moves ALL elections — THE ECONOMY. Stop worrying about the filibuster. Go to reconciliation on all measures that you can and get the 51 votes to get your agenda moving. Stop reaching out to the Repugnants. They will be even more obnoxious with the 41 votes they now have in the Senate.
Jon Stewart had a good bit about the Massachusetts race the night before the election. “Let me see if I have this straight. You need to replace perhaps the most beloved liberal in the history of the Senate with a candidate that believes Curt Schilling is a Yankee fan. Because if this lady loses, the health care reform bill that the beloved late senator considered his legacy will die,” Stewart said. “And the reason it will die is because if Coakley loses, Democrats will only have then an 18-vote majority in the Senate. Which is more than George W. Bush ever had in the Senate when he did whenever the f**k he wanted.” Check it out here.

Goodbye to the Aughties January 1, 2010

Whew! The naughty aughties seemed like a very long decade to me. I know, I know – some purists actually think the decade does not end until the beginning of 2011 but not me. I am quite happy to say goodbye to the last 10 years. I really do not want to rush the passage of time, but it was a tough ten years. My memory of the aughties begins with the nutty Y2K non-meltdown and quickly turns to the life altering hanging chad debacle. The thugging in of the Bush-Cheney nightmare still hangs heavily on the entire world. September 11, 2001 transformed everything. Fast forward to the amazing election of an African-American as President of the United States and voila – here we are.
Am I optimistic? Am I pessimistic? I consider myself a realist (with a smidgeon of hope and cynicism thrown into the mix). I will keep fighting the good fight and will keep writing and ranting until there is nothing left to say, I give up or I find something else that occupies my time and thoughts. So, here’s wishing you all a very Happy New Year and new decade.

I am sick. Sick and tired of the craziness of this August health care ‘debate.’ I have not been posting very much because my head is exploding. The crazies have been let loose and are being given microphones, strap on guns (Frank Rich addresses the gun issue today.) and are seen on youtube clips that echo endlessly. It was only one year ago that these same people were screaming at Repugnant rallies that Obama was pal’ing around with terrorists and that he was a Muslim. What is it about August? We won a HUGE majority in November. We took the House, Senate and White House. Why is Obama trying to appease the Repugnants when they have absolutely no intention of voting for any bill to ‘reform’ health care. They did not want the Civil Rights Bill to pass, they did not want the Voting Rights Bills to pass, they did not want Affirmative Action to pass. I could continue with the list, but you get the point. They are the party of ‘NO.’
Obama’s big mistake was to allow these Congressional whores to come up with health care on their own. What was he thinking? I still believe that the Democrats will pass health care reform WITH a public option and if they do not do that – I say shame, shame shame.

– Rachel Maddow talks about the Gang of Six. They are the six senators who have crowned themselves the ones to create ‘the’ bill on Health Care. These three Democratic senators in the gang are from Montana, New Mexico, and North Dakota – states that together account for just over 1 percent of Americans. The three Republicans are from Maine, Wyoming, and Iowa, which together account for 1.6 percent of the American population. The Democrats are Max Baucus of Montana, Jeff Bingaman of New Mexico and Kent Conrad of North Dakota and the three Republicans are Charles E. Grassley of Iowa, Olympia Snowe of Maine and Mike Enzi of Wyoming.

The very next day after this segment was aired the following was released: CANTEL MEDICAL CORP. (NYSE: CMN – News) announced that on August 20, 2009 it received a letter of resignation from Ms. Elizabeth McCaughey as a director of the Company. Ms. McCaughey, who had served as a director since 2005, stated that she was resigning to avoid any appearance of a conflict of interest during the national debate over healthcare reform.
– FYI: On Betsy McCaughey’s past: For those of you who did not experience Betsy’s bizarre career in New York politics in the 90’s, a bit of background. Betsy was picked out of thin air as Pataki’s running mate in 1996. Following their election, she took umbrage that her “policy papers” were not being taken seriously by the Pataki administration, famously stood during Pataki’s entire State of the State address, announced that her phones were being checked for “bugs,” and was subsequently shunned by the entire state Republican establishment.
In 1998 Pataki dumped Betsy from the ticket. She then ran for governor against him on the Liberal Party line after losing the Democratic Party nomination, a campaign financed almost entirely by her then-husband, Wilbur Ross, a billionaire steel magnate who pledged over $2M to her campaign, before he came to his senses and withdrew his funds, leaving her stranded. The day after Betsy inevitably lost the election, Ross filed for divorce, a divorce which made them a test case in the validity of post-nuptial agreements. Ross was rumored to have been forced to sell off his art collection in order to pay for the divorce settlement. He has since remarried.

I am not the only Judy-One-Note out there. President Obama desperately wants to turn that proverbial page but we just will not let him do that so easily. I think that so many people all over the political spectrum want some justice on the Bush years because the masses have finally woken up and it is not so pretty out there. How did we all get bamboozled? Why are we in such a mess? Did the Emperor have no clothes? The Bush bubble has broken and heads need to roll. For the life of me I cannot figure out why Obama does not simply appoint a Special Prosecutor to handle the torture/war mess and move along. Yes, it might get a bit ugly but I am certain we can handle the memos, photos, lies, crimes and outrages. We are not a nation of babies. In order to be certain that behavior like that which was perpetrated by the Bush/Cheney team does not repeat itself we need to disinfect in the clean light of the sun.
The Repugnants have once again framed this issue to their liking. They are now trying to blame Nancy Pelosi for knowing about the torture. That is not the issue. The issue is that water boarding is a war crime. The discussion now needs to be re-framed by the left as one of War Crimes and who ordered them? How many years those perpetrators should serve in prison is the real issue. Let’s get back to basics. If, in fact, any Democrats were co-conspirators then let’s let the chips fall where they may.
– Frank Rich eloquently write about why Obama cannot turn the page on the Bush years in today’s column. ‘To paraphrase Al Pacino in “Godfather III,” just when we thought we were out, the Bush mob keeps pulling us back in. And will keep doing so. No matter how hard President Obama tries to turn the page on the previous administration, he can’t. Until there is true transparency and true accountability, revelations of that unresolved eight-year nightmare will keep raining down drip by drip, disrupting the new administration’s high ambitions’.
– Here is what the NY Times had to say about the reversal of policies on Photographs and Kangaroo Courts. “It was particularly distressing to hear Mr. Obama echo Mr. Bush by saying that releasing the pictures would not add “to our understanding of what was carried out in the past by a small number of individuals.” This was not the fault of a few individuals. It was widespread, and systemic, the result of policies set at the highest levels of the Bush administration. Mr. Obama was elected in part because of his promises to correct these lawless policies. He must create clear rules to deal with prisoners. And there must be a full accounting of what went so horribly wrong and how. Otherwise, Mr. Obama risks turning Mr. Bush’s mistakes into his own or, in the case of the photographs, turning Mr. Bush’s cover-up into his own. More important, he risks missing the chance to make sure the misdeeds and horrors of the Bush years are never repeated.”

– Jon Stewart manages to skewer issues in perfect pitch. Lt. Dan Choi is an Arabic translator that is being fired from the military for admitting that he is gay. Jon Stewart finds hypocrisy in that the government will bend its moral standards to allow waterboarding but then fires the resources that could translate the results of that waterboarding.

If Dick Cheney wants so very much to be in the spotlight how about we bring him up on those overdue war criminal charges? If he needs attention, this would be a fine way for us to reveal it. Those that say he is a believer and really thinks his way in the only way, I say, as he did – so? He broke the law and needs to be punished. Oh oh – this just in – President Barack Obama is seeking to block the immediate release of hundreds of photos showing U.S. personnel allegedly abusing prisoners in Iraq and Afghanistan. Is this right out of the Bush/Cheney playbook? An Obama administration official said Wednesday that the president told his legal advisers last week that releasing the photos would endanger U.S. troops.

Raise your hand if your preferred Dick Cheney in an undisclosed location. In the eight long years that the evil Dick ruled over the land – secrecy was the word of the day. There was no meeting, no ruling, no decision that the Dick felt needed to be shared with the public. After all – he knew what was right and needed no nodding public to throw in their approval of his deeds. Now, the ubiquitous Dick is all over the airwaves. Fox might as well give him his own show. He is even now requesting that the information gotten through his torturous methods be released to the public. The New York Times today in an editorial on the subject suggests that Cheney’s motive lies in the old saying that the ends always justify such barbaric means.
I have been beating the drum on the torture issue for a very long time. Apparently President Obama’s decision to ‘move forward’ is not sitting well with lots of other people. Eric Holder has lots to do as does Congress and the more information that comes out before a special prosecutor is appointed the better.
Condoleeza Rice is not coming out smelling like a rose on this matter either. ‘Rice’s role was detailed in a narrative released Wednesday by the Senate Intelligence Committee. It provides the most detailed timeline yet for how the CIA’s harsh interrogation program was conceived and approved at the highest levels in the Bush White House. The new timeline shows that Rice played a greater role than she admitted last fall in written testimony to the Senate Armed Services Committee.’
F.B.I. director, Robert Mueller is coming out smelling like a rose in this entire saga. The CIA, the Dick and all of his cronies, passed over the FBI in the interrogation business and allowed the CIA to handle the whole nasty business. Read this interesting article from the NY Times Opinion page on the subject by Ali Soufan (Ali Soufan was an F.B.I. supervisory special agent from 1997 to 2005), called ‘My Tortured Decision’
– On the Rachel Maddow Show, Rachel talks with Ron Suskind about the White House ordered torture program, created before the war in Iraq began for the purpose of finding a link between 9/11 and Saddam Hussein, in order to justify attacking Iraq.
– Jon Stewart nails it on the head again. Best quote is: “Apparently everyone’s not upset about the fact that we torture. They’re upset about the fact that we know about it.”
– Constitutional Law Prof. Jonathan Turley (of George Washington University) joins David Shuster (subbing for Keith) to talk about what the Justice Dept.’s next course of action will be in pursuing accountability for the torture for the torture of U.S. detainees.
– And then there is the Jane Harmon story. The Congresswoman from CA was caught on one of those wiretaps in an ‘oops’ moment. Not surprising, it turns out that world loves Obama. This love breaking out all over the world is another clear indictment of how much George W. Bush and his group of thugs were hated. Imagine going to a summit where the leader of the free world will actually engage in a discussion without resorting to shoulder massages, goofy sneers or stupid frat jokes. Those are just some of the reasons Obama was such a big hit in the G20 meetings. Don’t believe me? Check out this item from thinkprogress insinuating that Bush did not even know what the G20 was. Gasp.
– Here’s what happened yesterday:
– Oh oh – Pat Leahy suggests that truth commission is ‘not going to happen.’ What does this mean? Does this mean the torture/war crimes issue is going in another direction? Perhaps with a special prosecutor? Stay tuned to this Judy-One-Note issue.
– If you missed the piece that Jon Stewart did on Rush Limbaugh‘s rant that he was going to leave NYC because of the possibility of having to pay higher taxes. “For years, for years, for years, New Yorkers have done everything in our power to get this guy to leave town,” Stewarts joked. “We passed laws making it tougher for hot dog vendors to sell along the streets. We hold gay pride parades and there are barely any gay people in the city so we shipped them in.” It is a hoot.
– And then there is the Ted Stevens mess. From the NY Times today – “For eight years the Bush Justice Department cynically put politics and ideology above the law. So it is gratifying to see how Attorney General Eric Holder is handling the case against Ted Stevens, the former Alaska senator who was convicted last year on seven felony counts of ethics violations.” Does this mean that Ted Stevens was innocent? Not at all. But the Justice Dept should be held to higher standards than Ted Stevens. Eric Holder has lots to do. Stay tuned.

Talk about strange overlaps. While walking my dog Benny (who does not yet acknowledge the fact that we turned the clock back an hour last night), I noticed the Halloween revelers were still walking home while the NYC Marathon buses filled with anxious runners, were headed to Staten Island to await the start later this morning. I guess that there are both party marathoners and running marathoners, right?
– Since people are taking part in both activities at the same time I decided I can write about the Marathon and still be celebrating Halloween. So, the above photo of Benny is my little Halloween greeting to you and yours.
